This Privacy Policy covers how Populus Technologies, Inc. a Delaware corporation ("Populus", "we", "our", “Company”) collects, uses, discloses and stores information about you ("personal information",”you”) when you use our website or platform (“Services”) or as part of the recruitment process. For the purposes of this Privacy Policy, Populus is a Processor (provides services to its customers) when it gathers data from its customers to provide Populus’s Services. Populus is a controller (i.e. the responsible party determining how data is to be used) for data gathered for its own purposes, including website visitors, recruiting, and marketing.

To provide our services to you and to ensure that our software and platform operate correctly, we collect various types of information, including personal information. When you use our website, sign up for our services, and use our software or platform, we collect the following categories of information:

Internet Protocol Address (“IP address”).
IP addresses are assigned by your Internet service provider to the modem used to access the Internet for connected devices in your home and/or work-place. Our Services receives your IP address from your Internet browser each time you request a file or web page.
User-Agent.
Every time you access the Services, this User-Agent data may be automatically sent by your web browser and includes, but is not limited to, data associated with the source device’s browser type and browser version, device type (e.g., computer, tablet, mobile device), unique device identifiers, date/time of visit, the time spent on specific pages, and other diagnostic data

We use Cookies and similar tracking technologies to track the activity on our Services and store certain information. Tracking technologies used are beacons, tags, and scripts to collect and track information and to understand and improve the performance of Populus’ Services.
Cookies can be "Persistent" or "Session" Cookies. Persistent Cookies remain on your personal computer or mobile device even after they close your browser while Session Cookies are deleted as soon as you close your web browser. Legal Basis for Collecting and Using Information
If you are a user of the Populus website or platform located in the EEA, we rely on several processing purposes, such as legitimate interest, as the legal basis for processing the personal information we collect via the website and platform. For instance, we may collect, process or disclose your personal information based on the following bases:

We may disclose de-identified information (i.e., information with personal identifiers removed) for a variety of reasons, including under the following circumstances:
Product Improvement: To improve our products
Company Acquisition: If Populus is acquired or merged with another company, we will transfer aggregate information to the acquiring company.
Compliance: To comply with a subpoena or court order, to establish or exercise our legal rights or defend against legal claims, or to cooperate with government and/or law enforcement officials.
Lawful basis: For any lawful basis.
Security
We take security very seriously. Populus has implemented reasonable technical, administrative and organizational security controls designed to protect the confidentiality, integrity, availability and resilience of data. These measures include utilization of encryption technologies, creation and maintenance of policy overseeing the management of the security program, role-based access controls, password management, vulnerability management, and secure software development protocols.
Data Retention
The time period for which we retain your personal information depends on the purpose for which we use your personal information and the applicable law for that type of personal information and use. Populus will keep your personal information for as long as you are using our services and platform or as long as we have a valid business purpose to do so and, thereafter, for no longer than is required or permitted by law. Other information collected during your use of our website will be kept until you withdraw consent or your information is no longer needed for marketing or analytical purposes. Populus will also retain usage data for internal analysis purposes. Usage data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Services, or we are legally obligated to retain this data for longer time periods.
E.U. - U.S. Data Transfers
For visitor-facing components of Populus, such as the Populus EU platform, all personal information is stored exclusively in Dublin, Ireland. Other than published content that is explicitly authorized by customers, Populus does not transmit customer data to third party systems with the exception of Google’s Cloud environment (GCP), which adheres to similar and stricter data protection standards than Populus. All Populus applications and data storage are entirely hosted within a Virtual Private Cloud within GCP. Nevertheless, certain personal information may be stored or accessible outside of the European Economic Area. Populus shall remain liable under the EU-U.S. Data Privacy Framework (DPF) Principles if GCP processes such personal information in a manner inconsistent with the DPF Principles, unless Populus proves that it is not responsible for the event giving rise to the damage.
For such transfers of personal information and/or where required by law, Populus relies on the Standard Contractual Clauses as a valid transfer mechanism. While Populus does not rely on the EU-U.S. Data Privacy Framework certification as a basis for international data transfers, Populus continues to comply with the EU-U.S. Data Privacy Framework Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union to the United States. Populus has certified to the Department of Commerce that it adheres to the Data Privacy Framework Principles. In compliance with the EU-U.S. DPF, Populus commits to cooperate and comply with the advice of the panel established by the EU data protection authorities (DPAs) with regard to unresolved complaints concerning our handling of human resources data received in reliance on the EU-U.S. DPF in the context of the employment relationship. EU individuals with inquiries or complaints regarding the Data Privacy Framework should first contact Populus at: Populus Technologies, Inc., 177 Post Street, Suite 200, San Francisco, CA 94108. Populus is obligated to arbitrate claims and follow the terms as set forth in Annex I of the DPF Principles, provided that an individual has invoked binding arbitration by delivering notice to Populus and following the procedures and subject to conditions set forth in Annex I of Principles. Under certain conditions, individuals have the option to invoke binding arbitration. Populus has further committed to refer unresolved Data Privacy Framework complaints to JAMS, an alternative dispute resolution provider in the United States. If you do not receive timely acknowledgment of your complaint from us, or if we have not addressed your complaint to your satisfaction, please visit https://www.jamsadr.com/dpf-dispute-resolution for more information or to file a complaint. The services of JAMS are provided at no cost to you. For purposes of enforcing compliance with the Data Privacy Framework, Populus is subject to the investigatory and enforcement authority of the U.S. Federal Trade Commission.
Other Provisions
Children's Privacy
The Populus website and Services were not developed or intended for individuals under the age of 18 and we do not knowingly collect information from children under the age of 18 years old. If you learn that your child has provided us with personal information without your consent, you may alert us at legal@populus.ai, and we will promptly take steps to delete such information.
"Do Not Track" and Global Privacy Control
Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. DNT is a way for users to inform websites and services that they do not want certain information about their webpage visits collected over time and across websites or online services. Please note that we do not respond to or honor DNT signals.

Populus’s website may contain links to other websites for your convenience and information. These websites may be operated by companies not affiliated with Populus. Linked websites may have their own privacy policies or notices, which we recommend you review if you visit those websites. This Privacy Policy only applies to personal information collected on this website. We have no control over third-party websites and are not responsible or liable for the content, privacy practices, or use of any websites that are not affiliated with Populus.
Your Rights

Appointing an authorized agent
